			<content:encoded><![CDATA[<p>After almost four years of vigorous litigation Shabel &amp; DeNittis has obtained a settlement on behalf 43 Westwind model homeowners who reside in the Weathervane Farms community located in Mt. Royal, New Jersey. The settlement provides each homeowner with approximately $15,900 to repair water damage and defects existing in the homes.  Homeowners claimed the builder and subcontractors were negligent in constructing their homes with common design defects such as misapplied stucco in violation of various building codes, lack of flashing, inadequate moisture barriers, and undersized gutters.  The lawsuit claimed these construction defects caused considerable water infiltration and damage into the homes requiring mold remediation, drywall replacement and flooring repairs.</p>
<p>Shabel &amp; DeNittis has successfully litigated numerous class actions and mass actions against Orleans Homebuilders, J.S. Hovnanian &amp; Sons, and PSE&amp;G for construction defects in over 10,000 consumers&#8217; homes through out New Jersey.  As result of Shabel &amp; DeNittis efforts, thousands of consumers through out the State have had their homes fixed or obtained money to fix their homes when the companies who caused such defects refused to take responsibility prior to Shabel &amp; DeNittis&#8217; involvement.</p>

			<content:encoded><![CDATA[<p><strong></strong>Shabel &amp; DeNittis, P.C. has obtained a settlement in a class action on behalf of 17,000 consumers in New Jersey against TRIDENT LAND TRANSFER COMPANY OF NEW JERSEY LP and TRIDENT INSURANCE AGENCY COMPANY LP, TRIDENT GROUP INC (collectively referred to herein as “Trident”).  The class action alleged that Trident collected Mortgage Recording Fees at New Jersey real estate closings from consumers that were higher than allowed under New Jersey law. Trident denied the allegations, but was in agreement to resolve the case.  Trident Abstract Title Agency, LLC, was not a part of this settlement and is not involved in this case in any way. Trident Abstract Title Agency, LLC, was dismissed early on in the case since it did not have any involvement in any of the allegations of the complaint.</p>
<p>The class settlement established a procedure whereby a claims reviewer will review the real estate sales documents for all Trident Title customers in New Jersey who submit a claim form under the settlement. Any customers who submit a claim who are found to have been overcharged will get 100% of the overcharge refunded.</p>

			<content:encoded><![CDATA[<p>Shabel &amp; DeNittis filed a proposed class action today on behalf of two Camden County residents in New Jersey Superior Court, Camden County,  against the owner of Locustwood Memorial Park, alleging that Locustwood is liable to replace hundreds of decorative bronze urns that were stolen from the cemetery by a Locustwood employee.  According to the complaint, Locustwood employee Matthew McGrenehan stole hundreds of urns from the cemetery during working hours over a year and a half, hauling them to a local salvage yard in a Locustwood truck and selling them for scrap. McGrenehan was arrested in January and has confessed to the thefts. The complaint is brought by the heirs of several persons whose graves were looted . The complaint alleges that Locustwood ignored evidence that these thefts were an inside job and that Locustwood failed to take reasonable steps to supervise its employee and to protect property left in the cemetery’s care. According to the complaint, Locustwood had ignored complaints from bereaved family members, telling those who complained not to bother Locustwood staff.  The suit seeks an order requiring Locustwood to replace the urns and repair holes left in graves as a result of the thefts.</p>

			<content:encoded><![CDATA[<p><strong>Summary of Case and Settlement:</strong>  Shabel &amp; DeNittis, P.C. has obtained preliminary approval of a settlement in a class action against Weichert South Jersey, Inc. d/b/a Weichert Realtors (“Weichert”) in the Superior Court of New Jersey, Burlington County, alleging that Weichert collected fraudulent Administrative Fees  (junjk fees) at real estate closings from consumers that were in violation of New Jersey consumer Fraud Act .  Weichert denied the allegations, but was in agreement to resolve the case.  Under the terms of the settlement, all class members from whom fees were collected are eligible to receive a partial refund.</p>
<p>On May 2, 2011, the Honorable Karen L. Suter of the Superior Court of New Jersey, Burlington County, entered an order granting preliminary approval of the settlement of this Weichert class action lawsuit.  To learn more details about the settlement, you can download the class notice and settlement agreement that are set forth below.  To make a claim, download the claim form set forth below and follow the instructions on the claim form to submit a claim.  All claims must be submitted to the claims administrator set forth on the claim form on or before September 2, 2011.  Your failure to submit a claim form by that time will prevent you from obtaining any recovery in this class action.</p>

			<content:encoded><![CDATA[<p>A $270,000.00 settlement was reached in the class action Blasini v. Prudential Fox &amp; Roach for alleged violations by Prudential of the New Jersey Consumer Fraud Act for charging an alleged unearned illegal fee of between $150 to $200 per sales transaction between 2005 and the present time. The case was settled on behalf of 4,000 Prudential sellers of property between 2005 and 2010. As a result of the settlement, sellers were given the opportunity to submit a claim form to receive a substantial refund from the amount that they were allegedly overcharged.</p>

Aquahab, LLC was settled on behalf of approximately 4,000 health club members who alleged they were overcharged for health club services in violation of the New Jersey Consumer Fraud Act, the New Jersey Retail Installment Sales Act and the Truth in Consumer Contract Warranty and Notice Act. All class members received $60 in services vouchers usable for a free month of health club services or for personal training.</p>
